1. Acknowledgment of Event Rules and Safety

1.1 I acknowledge that I have read, understood, and agree to comply with all event safety and race rules, as well as the decisions and instructions of event officials, the organizer, and the race director.

1.2 I understand that my entry may be voided and/or I may be disqualified from the event if, in the opinion of the race organizer, I fail to comply with these rules or bring the event or its sponsors into disrepute.

2. Physical Fitness and Health

2.1 I certify that I am physically fit and have trained sufficiently to participate safely in this event.

2.2 I declare that I am not aware of any health condition that could put myself, fellow participants, support crew, officials, spectators, landowners, or members of the public at risk as a result of my participation.

3. Assumption of Risk

3.1 I understand that participation in a triathlon involves physical exertion and inherent risks, including but not limited to injury, illness, loss, or death.

3.2 I acknowledge that I participate entirely at my own risk and accept full responsibility for my own safety throughout the event.

4. Safety Precautions

4.1 I acknowledge that safety precautions undertaken by the organizer are intended to assist participants but do not guarantee my safety. I agree to exercise personal responsibility and caution at all times.

5. Medical Treatment

5.1 I consent to receive medical treatment that may be deemed necessary in the event of illness, accident, or injury during the event.

5.2 I agree to pay any associated costs of such treatment, including ambulance transport or hospital care.

6. Event Changes and Cancellations

6.1 The organizer reserves the right to delay, alter, or cancel the event at any time due to weather conditions, safety concerns, natural disasters, government restrictions, or other circumstances beyond their control.

6.2 If the event is rescheduled or cancelled, I understand that my entry fee is non-refundable, unless covered under a separately purchased registration insurance policy.

7. Personal Property

7.1 I acknowledge that I am responsible for the security of my personal belongings at all times. The organizer accepts no responsibility for any loss, theft, or damage to personal items.

8. Liability Waiver

8.1 I waive, release, and discharge the organizer (Brand New Day Limited), its directors, employees, agents, contractors, sponsors, and volunteers from any and all liability for death, disability, personal injury, property damage, or any other loss arising from my participation in this event.

9. Indemnity

9.1 I agree to indemnify and hold harmless the organizer, its directors, employees, agents, contractors, sponsors, and volunteers from all claims, demands, actions, or liabilities arising from my participation or conduct in the event.

10. Data Protection and Privacy

10.1 I agree that my name and contact details may be collected and stored by the organizer for event administration and promotional purposes.

10.2 My information will not be shared with third parties without consent, except as required for event delivery (e.g., timing services or insurance).

10.3 I may opt out of receiving promotional communications at any time by contacting the organizer.

11. Media Release

11.1 I grant the organizer, sponsors, and event partners the unrestricted right to use my name, likeness, image, voice, and/or performance in event photos, videos, and promotional materials without payment or further consent.

12. Declaration

12.1 I declare that all information I have provided during registration is true and correct.

12.2 I certify that I am 18 years of age or older, or that I have obtained consent from my parent or legal guardian if under 18 years old.

13. Acceptance of Terms

13.1 By submitting my entry, I acknowledge that I have read, understood, and accepted these Terms and Conditions.

Refund and Deferral Policy

14. Refunds

14.1 No Refunds for Standard Registrations – As acknowledged during registration, no cash refunds will be provided under any circumstances for standard entries.

14.2 Refunds for Registrations with Insurance – If you have purchased registration insurance during the registration process, you may be eligible for a refund or transfer according to the terms of that insurance policy.

15. Deferrals and Transfers

15.1 Participants may request a one-time transfer of their entry to another SHE Women’s Triathlon event of equal value within the same or following calendar year, subject to availability and organizer approval.

15.2 Deferral requests must be submitted in writing no later than 30 days before the event date.

16. Acknowledgment of Policy

16.1 During registration, all participants are required to acknowledge and agree to these refund and deferral policies by selecting the relevant option on the entry form.

17. Waiver Confirmation

17.1 The event waiver, which all participants must agree to, reiterates that refunds are not available and refers to this policy for further details.
